M1NT INSERT CARD SWEEPSTAKES
Official Rules
NO PURCHASE NECESSARY. VOID WHERE PROHIBITED BY LAW.
BY ATTEMPTING TO PARTICIPATE IN THE M1NT SWEEPSTAKES, YOU FULLY AND UNCONDITIONALLY AGREE TO BE BOUND BY THESE OFFICIAL RULES AND THE DECISIONS OF M1NT REGARDING THE M1NT SWEEPSTAKES, WHICH WILL BE FINAL AND BINDING.
1. Sweepstakes Description. Each M1NT Hobby Case includes a randomly inserted sports trading card as part of the packaging. Each Hobby Case sold by M1NT provides you with an opportunity to obtain cards identified below (“Insert Cards”), or by participating in a free to enter sweepstakes (“M1NT Sweepstakes”), subject to the terms of these official rules (the “Official Rules”).
2. Sweepstakes Period. The Sweepstakes begins on the first date the Hobby Cases are available for sale and ends upon the sale of 10,000 Hobby Cases minus the number of entries received via mail pursuant to section 4 below (“Sweepstakes Period”). Entries submitted after the Sweepstakes Period will not be eligible.
3. Eligibility. The Sweepstakes) is open to legal residents of the United States and the District of Columbia who are at least 18 years old at the time of entry (or the age of majority in their state of residence, whichever is greater). Void where prohibited or restricted by law.
4. How to Enter. Customers are purchasing the M1NT Hobby Case, and any potential prize is incidental to such purchase of the M1NT Hobby Case. Insert Cards are randomly inserted into the M1NT Hobby Cases, or for a chance to obtain an Insert Card, while supplies last: hand print your name, complete return address, and dream collectible card, on a 3 x 5 card and mail in a #10 envelope to, including a self-addressed stamped return envelope, to the following address:

Only one 3 x 5 card per envelope and only entry per person will be permitted. Envelopes received with multiple cards, missing information, missing self-addressed stamped return envelope, or that are illegible may be rejected. Entries must be postmarked no later than 30 days after the Sweepstakes Period.
5. Insert Cards. The Insert Cards vary in relative value from $0.05 to $6,000. The approximate retail value (“ARV”) of the total collection of 10,000 Insert Cards is $41,075. A breakdown of Insert Card tier values is as follows:

No substitution, transfer, or cash equivalent of Insert Cards is permitted. All taxes and other expenses not specifically identified as included are the sole responsibility of the recipient.
6. Odds of Winning. The 10,000 Insert Cards will be randomly assigned between the purchased M1NT Hobby Cases and the number of mail entries for a total of 10,000 Insert Cards (for example, if M1NT receives 100 mail entries, the Insert Cards will be randomly allocated to 9,900 M1NT Hobby Cases and 100 mail entries). Each of the M1NT Hobby Cases purchased and each mail entry shall be entitled to 1 of the 10,000 possible Insert Cards and will be randomly selected by M1NT during the Sweepstakes Period. Any entries received during the Sweepstakes Period via mail will be randomly assigned 1 of the 10,000 possible Insert Cards. The odds of winning a Tier 1 Insert Card (approximate value of $.05) are approximately 1 in 3; the odds of winning a Tier 2 Insert Card (approximate value of $.25) are approximately 1 in 4; the odds of winning a Tier 3 Insert Card (approximate value of $.50) are approximately 1 in 6; the odds of winning a Tier 4 Insert Card (approximate value of $1.00) are approximately 1 in 8; the odds of winning a Tier 5 Insert Card (approximate value of $3.00) are approximately 1 in 10; the odds of winning a Tier 6 Insert Card (approximate value of $10.00) are approximately 1 in 20; the odds of winning a Tier 7 Insert Card (approximate value of $25.00) are approximately 1 in 100; the odds of winning a Tier 8 Insert Card (approximate value of $50.00) are approximately 1 in 50; and the odds of winning a High Value Insert Card (approximate value of $6,000.00) are approximately 1 in 3,334. Noncompliance with any of these Official Rules, in M1NT’s sole discretion, will result in disqualification. M1NT assumes no responsibility for incorrect, inaccurate, or late entry information whether caused by any human error or otherwise.
7. General Conditions. M1NT reserves the right to cancel, suspend, or modify the Sweepstakes if fraud, technical failures, or any other factor beyond M1NT’s reasonable control impairs the integrity of the Sweepstakes. M1NT is not responsible for lost, late, misdirected, incomplete, or illegible entries.
8. Disputes. By entering, participants agree that all disputes will be resolved individually, without resort to any form of class action. All issues and questions concerning these Official Rules, participants’ rights and obligations, or the rights and obligations of M1NT shall be governed by the laws of the State of California without giving effect to conflict-of-law rules.
9. Indemnification. You agree to indemnify and hold harmless M1NT and each of its affiliated companies, parents, subsidiaries, officers, directors, employees, agents, members, successors and assigns (collectively, the “Indemnified Parties”) from and against any and all liabilities, claims, suits, losses, damages, expenses and costs (including, but not limited to reasonable attorneys’ fees) resulting or arising from: (a) the M1NT Sweepstakes, including your participation therein, and/or (b) any breach or violation of any representation, warranty, obligation or covenant made by you. Further, you agree to release all rights to bring any claim, action or proceeding against the Indemnified Parties, to release all rights to bring any claim, action or proceeding against the Indemnified Parties, and hereby acknowledge that the Indemnified Parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the M1NT Sweepstakes.
10. Release. By entering the M1NT Sweepstakes, you hereby release and hold harmless the Indemnified Parties from and against any and all losses, damages, rights, claims, and actions of any kind arising in whole or in part, directly or indirectly, from the M1NT Sweepstakes or participation in the M1NT Sweepstakes, as well as claims based on publicity rights, defamation, and/or invasion of privacy.
11. Waiver of Incidental and Consequential Damages. In no event will the Indemnified Parties be responsible or liable for any damages or losses of any kind, including without limitation, direct, indirect, incidental, consequential, or punitive damages, arising out of your participation in the M1NT Sweepstakes. Without limiting the foregoing, the M1NT Sweepstakes, m1nt.com, and all related activities and materials provided on or through the M1NT Sweepstakes are provided “AS IS” without warranty of any kind, either express or implied, including without limitation the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Dispute Resolution. All claims and disputes within the scope of these Official Rules must be arbitrated on an individual basis based solely on your or our own alleged losses and not on a class, representative or collective basis. Only individual relief is available and claims of more than one M1NT Sweepstakes participant cannot be arbitrated together or consolidated with those of any other M1NT Sweepstakes participant. Accordingly, you waive all claims by and on behalf of other persons, including actions asserting rights by statute or otherwise.
You agree that any dispute, claim or controversy arising out of or relating to the M1NT Sweepstakes or these Official Rules (including without limitation any dispute concerning the breach, enforcement, construction, validity, interpretation, enforceability, or arbitrability of these Official Rules) (collectively, a “Dispute”), shall be resolved through binding arbitration, including claims that arose before acceptance of any version of these Official Rules containing an arbitration provision. In addition, in the event of any Dispute relating to the Official Rules, including validity, interpretation, enforceability, or arbitrability, were to be determined in arbitration under these arbitration provisions of these Official Rules, you agree that the arbitrator exclusively shall have the power to rule on his or her own jurisdiction over the Dispute, including any objections with respect to the existence, scope or validity of the arbitration agreement, or to the arbitrability of the claims or counterclaims presented as part of the Dispute.
The parties acknowledge that the agreement in this section to arbitrate any Disputes on an individual and case-by-case basis is a separate agreement for purposes of the Federal Arbitration Act in addition to the Official Rules. The alleged invalidity of the Official Rules shall have no effect upon the validity of our mutual agreement to arbitrate any Disputes under this section. In addition, if any portion of this section is determined by a court to be inapplicable or invalid, then the remainder shall still be given full force and effect. The Federal Arbitration Act governs the interpretation and enforcement of these Official Rules. To begin an arbitration proceeding, you must send a letter requesting arbitration and describing your claim to M1NT at M1NT, INC. 2810 Church St. #91481 Wilmington, DE 19802, ATTN: Legal Department. The arbitration will be conducted by JAMS in Los Angeles before a single arbitrator subject to JAMS’s most current version of the Streamlined Arbitration Rules. Any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction. Each party shall bear its own legal fees and the costs of such arbitration shall be shared equally between the parties.
13. Waiver of Jury Trial. You hereby waive any constitutional and statutory rights to sue in court and have a trial in front of a judge or a jury. You are instead electing that all claims and disputes shall be resolved by arbitration as outlined above.
